The new Right To Work check rules come into force from the 1st of October and Checkback is now offering Digital Identity Check (IDVT) services as part of the checking process.

For our current clients we are able to integrate a fully compliant IDVT journey within your checking service meaning that you do not have to worry about running these checks yourself.

From 1st October 2022 – What you have to do

If you are onboarding new hires then you must by law carry out checks with enough confidence levels to satisfy the reasonable excuse rules and keep the results for a minimum of two years after the end of employment.

There are two ways to do this; The first is to carry this out manually just like you did prior to COVID. The second is to use an authorised IDSP (IDentity checking Service Provider) to do this for you.

The digital IDSP route is only available for UK citizens and Irish citizens with an identity card. Other nationalities must be checked using the government’s own share code system.

Manual checks

The first thing we would like to say is that there is a large amount of misinformation out there about IDVTs.

You don’t HAVE to use an IDSP to run your pre employment checks. It is perfectly acceptable to do manual ID checks in the workplace.

But you must;

  • Have original documents in front of you
  • Check the documents against the correct template
  • Make sure the documents haven’t been tampered with
  • Check for fraud
  • Make sure the document matches the person you are employing (a ‘liveness’ check)
  • Keep adequate records to show that you have a reasonable excuse

For many employers, especially where there is a single base and everyone is working locally this should be no problem as you can have the new hire sitting in front of you in an office.

The difficulty with this of course is that it takes a lot of time and you have to make sure you are doing all of the checks to the required standard as per the government’s RTW guidance.

If you have remote workers, or where you have more than one base then an identity check using an IDSP is probably the best way to go.

Using the Checkback IDSP route

We run a totally separate IDVT check, delivered by email or SMS that your candidate completes in their own time.

The system includes an AI-led liveness check, address checks and passport checks with major agencies.

At the end you receive a RTW report, integrated with your other reports that you can then store as your RTW compliance evidence.

Our process is totally GBG44 and GBG45 compliant and requires no further input from you other than the normal information that we collect as part of our pre-employment screening service.
